Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://meltsandtreats.com website (the “Service”) operated by Melts and Treats (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

ACCOUNTS

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Referral & Wallet Program

Defined Terms
Referrer: you, a registered Melts and Treats customer and a legal resident of the continental United Kingdom.

Referred Customer: a friend or family member who has not previously shopped with Melts and Treats before and to whom the Referrer shares their link. A “friend” is a person with whom you communicate frequently and have met in person before. A “family member” is a person who is your parent, sibling or child or a person with whom you are related through marriage or common-law partnership.

Balance credited for referring a visitor £0.10p (ten pence sterling).

Max per week for referring a visitor is £3.00 (three pounds sterling).

Balance credited for referring a new account sign up £0.50P (fifty pence sterling).

Max per week for referring a new account sign  is £3.00 (three pounds sterling).

Referral Link: a personalized referral link, provided to you by Melts and Treats.

Referral Product: a promotional merchandise to be mailed to you according to milestones reached. Referral Products are while supplies last, and may be swapped out per Melts and Treats discretion for a similar product of equal value.

Referral Credit: Digital monies. Referral credits can only be applied to continental U.K. based customers.

Referral and Wallet Credit Exclusions Each Referral and Wallet Credit are non-transferable, not valid for cash or cash equivalent, cannot be withdrawn, cannot be combined with other offers, and must be used in the currency in which it was received. Referrers are responsible for any and all tax liability resulting from any Referral Credit, and responsible for any shipping charges. Referral and Wallet Credit may be redeemed on meltsandtreats.com only, cannot be redeemed in stores, and may not be applied to any prior purchases, taxes, shipping and delivery charges, or toward the purchase of gift cards or apparel. Referral Products are not able to be returned or refunded for cash, credit, or future purchases. In the event a referred person returns a purchased item relating to the Melts and Treats Referral Program, the associated Referral Credit awarded to the referring customer will be rescinded.

Melts and Treats reserves the right to review, investigate, and disqualify any Referral Credit that violates the Melts and Treats Referral Program, such as attempting to gain a Discount through self-referral by using a different email address, or distributing a Referral Link via commercial advertising or spam. Melts and Treats may delay any Discount for the purposes of investigation and may refuse to verify and process any transaction for any reason. If you cancel your order, the Discount may no longer be valid or may be withdrawn.

Referrers should only invite a friend or family member after receiving prior permission from the Referred Customer to send. Referrers must comply with all up-to-date “SPAM” laws and marketing regulations, which may include the laws where the intended Referred Customers live. For example, emails must be created and distributed in a personal manner and bulk email distribution is prohibited. Any distribution of the Referral Link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Melts and Treats’s Referral Program. Melts and Treats automatically disqualifies suspicious referrals.

INTELLECTUAL PROPERTY

The Service and its original content, features and functionality are and will remain the exclusive property of Melts and Treats and its licensors.

DISCOUNT & PROMOTIONAL CODES

  • Promotion codes are only valid for orders placed online.
  • Promotion codes entitle you, at the time of ordering, to a saving on a new order placed with Melts and Treats.
  • Our 10% first order discount code is only valid one time with a minimum purchase of £6.
  • Promotional & discount codes are not valid on gift voucher purchases.
  • Melts and Treats reserves the right to decline to accept orders where, in its opinion, a promotion code is invalid for the order being placed.
  • Promotion codes are only valid on specific products while stocks last and may be withdrawn at any time.
  • Only one promotion code can be used per order.
  • Promotion codes are not valid in conjunction with any other promotion. Offer is not valid on sale items or other discounted items.
  • In the event of product returns, refunds will be given for cash used in the original purchase once the discount is applied, less any shipping, gift wrap or gift card costs charged on the original order.
  • In the event of part of the order being returned, the value of the discount applied on that order will be spread between the goods proportionately. The sum in cash exceeding this value, less any shipping, gift wrap or gift card costs charged on the original order, will be returned to the customer. The promotional discount will not be applied to replacement items, if the offer is still valid at the time of making a return – you should place a new order using the original promotional code.
  • In the event of part of the order being returned, the value of the promotion code will be deemed to be spread between the goods proportionately. The sum in cash exceeding this value, less any delivery or gift box costs charged on the original order, will be returned to the customer.
  • In the event of any returns meaning that the order no longer qualifies for the promotion advertised, Melts and Treats reserves the right to deduct the value of the offer from the refund.
  • Free delivery offers apply to UK standard 2nd Class delivery only.
  • In promotions where there is a free or half price item when purchasing multiple items, please note that the discount will be applied to the cheapest item.
  • Melts and Treats reserves the right to change these Terms and Conditions at any time.

LINKS TO OTHER WEB SITES

Our Service may contain links to third-party web sites or services that are not owned or controlled by Melts and Treats.

Melts and Treats has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Melts and Treats shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Order On-Hold


If we detect an issue or discrepancy with your order such as an incorrect shipping method being selected, your order maybe placed on-hold until we can rectify and correct the issue. Orders on-hold for longer than 7 days maybe cancelled and monies returned via your original payment method.

Payment Processing

Your credit card will be charged at the time your order. Your item will ship when it becomes available. See release date information below.

Availability

Occasionally, manufacturers will limit the amount of a product available. If this happens, we will process the online orders in the order in which they were received.

Promotional Items

From time to time, Melts and Treats will offer a special promotional item with a pre-order. Due to limited availability, these items are only available while supplies last.

Delivery

Orders containing both pre-orders/backorders and in-stock merchandise will be held until all pre-ordered or backordered items are in stock at Melts and Treats, after which we will ship the entire order. If you would prefer to receive your in-stock items sooner, please place a separate order for your in-stock items.

For orders only containing pre-ordered and backordered items, they will be shipped to customers as soon as we receive them from the manufacturer and process them for fulfillment.

Pre-order Release Dates

Melts and Treats works tirelessly with our suppliers to ensure accurate release dates on our site. Occasionally, suppliers run into problems or issues and the release date must be changed. Sometimes dates move forward; more often they move back, and frequently they get changed more than once.

If an item is scheduled for release far in the future, the vendor may not even give us a date. In those cases we rely on the collective wisdom of our buying staff to estimate a date based on their knowledge of the industry and the vendor’s history.

We guarantee that we will always post the best release date information available at the time of our posting.
Cancellation

Pre-ordered/backordered items can be cancelled up to 7 days before the shipment date listed on the product details page. If a pre-ordered/backordered item is within 7 days of the shipment date, no refunds will be processed for that item before shipment. This is due to processing and shipping times needed to fulfill these items and the time it takes for the item to be delivered to you.

If in the rare circumstance we cannot fulfill your pre-order/backorder item for any reason, your order for the pre-ordered/backordered item will be cancelled and the amount for your order or item will be refunded promptly, and you will be notified via the email address on your account.

TERMINATION

 

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

PRODUCT PACKAGING

Item(s) may be missing original packaging, or in its original packaging but not sealed due to quality testing.

DISCLAIMER

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
